This Pyx Health Consumer Website Privacy Policy Addendum (“Texas Addendum”) supplements our Website Privacy Policy (“Website Privacy Policy“) and applies solely to individuals who are Texas residents (collectively “Texas Consumers”).

If you are a Texas Consumer that visits or interacts with our website (www.pyxhealth.com) and related online services that link to the Website Privacy Policy (collectively, our “Website“), the below may apply to you. This Texas Addendum does not apply to our platform. This Texas Addendum describes consumer rights under the Texas Data Privacy and Security Act (“TDPSA”) and explains how to exercise those rights. Any terms defined in the TDPSA have the same meaning when used in this Texas Addendum. To the extent there is any inconsistency between our Website Privacy Policy and this Texas Addendum, the terms of this Texas Addendum apply.

The TDPSA protects information that is linked to or is reasonably linkable to an identified or identifiable consumer (“Personal Data”). Personal Data does not include information that is de-identified or publicly available. The TDPSA excludes other categories of information that we do not list here.

PERSONAL DATA WE MAY COLLECT YOUR PERSONAL DATA

The categories of Personal Data we may collect, how we may use that Personal Data and the categories of third-parties to whom we may disclose that Personal Data, are included in our Website Privacy Policy. Specifically, we may collect, use and disclose:

  • Communications with Pyx Health, including emails, messages, or recorded support calls.

The Right to Know, Access, and Obtain a Copy of Personal Data. Upon verification of your identity, you have the right to know whether we hold Personal Data about you, to access that Personal Data, and to obtain a copy of that Personal Data you previously provided us (if that Personal Data is in a digital format, and it is technically feasible to provide you a copy).

The Right to Correct. You have the right to request that we correct inaccurate Personal Data that we collected and maintain about you.

The Right to Request Deletion. You have the right to request that we delete the Personal Data that we hold about you.

The Right to Opt-Out of Selling Personal Data and Targeted Advertising. To the extent applicable, you have the right to opt-out of processing your Personal Data for the purposes of: (i) targeted advertising; (ii) the sale of your Personal Data; or (iii) profiling in furtherance of a decision that produces a legal or similarly significant effect. We may ask you to provide additional Personal Data, such as name and date of birth so that we can properly identify you in our data systems. We will only use Personal Data provided in a request to review to comply with your request. If you choose not to provide this information, we may only be able to process your request to the extent we are able to identify you in our data systems. In certain circumstances, we may decline a request to exercise the rights described above. You may designate an authorized agent to exercise your rights on your behalf.

Our Response. We will try to respond to a verifiable consumer request within forty-five (45) days of receipt. If we are unable to process your request in such time, we will inform you of the delay in writing by mail or email. Information provided in response to a consumer request will be provided free of charge up to twice annually.

If a request is manifestly unfounded, excessive or repetitive, we may charge a reasonable fee to cover the administrative costs of complying with the request or may decline to act on the request. If we determine the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Right to Appeal. If we are unable to comply with all or a portion of your request, we will explain the reasons we cannot comply. We will inform you of any action taken or not taken in response to the request and explain the reasons for our decision within sixty (60) days of receiving the request. CHANGES TO THIS TEXAS ADDENDUM

We reserve the right, at any time, to add to, change, update, or modify this Texas Addendum. We reserve the right to provide data and privacy transparency as required by law. If we decide to change this Texas Addendum, we will notify you by posting a new policy through our Website and change the “Last Updated” at the top of this Texas Addendum. Any change, update, or modification will be effective immediately upon posting to our Website and will apply to any Personal Data provided to us on and after that date. If we make material changes to the type of Personal Data collected, or how we share, use or sell Personal Data, we will provide you with notice to the e-mail address you provided, if you provided one. It is important that you monitor this Texas Addendum and your e-mail for changes to this Texas Addendum. We may also request that you confirm you have read this Texas Addendum and any revised version before we provide you access to our Website. We will accept your continued use of our Website after we make changes to be acceptance of those changes.

Changes to the Texas Addendum will not affect our use of previously provided Personal Data.
