Platform Privacy Policy

Your privacy is important to us. This Platform Privacy Policy (“Privacy Policy”) explains how Pyx Health, Inc. (“we,” “us,” and “our”) collects, uses, stores and shares your personal information on behalf of our health plan, health care provider, and other clients who choose to offer our services to their patients or members. It only applies to the personal information we collect in connection with the Pyx Health progressive website application (the “App”) and Compassionate Support Center (“CSC”) (collectively, the “Platform”). This Privacy Policy does not apply to personal information or other information we collect outside of the Platform, on our business-to-business website (www.pyxhealth.com), or on our HiFriend Network.

Your use of the Platform means that you agree with this Privacy Policy and future changes to it. IF YOU DO NOT AGREE WITH ALL OF THE PROVISIONS OF THIS PRIVACY POLICY, THEN YOU MUST NOT USE OR MUST STOP USING THE PLATFORM IMMEDIATELY.

What information Pyx Health collects about you

We collect and store any information you share on the Platform. The information we collect includes information that can identify you (“personal information”). Your health care provider or health plan (or third party that works on behalf of, or provides services to, your health plan or health care provider) may also share personal information about you with us in connection with your use of the Platform. The personal information we collect about you might include but is not limited to:

  • First and last name(s) (including your real name and aliases);
  • Unique personal identifiers or online identifiers;
  • Email address(es) and phone number(s);
  • Location(s), including postal address and physical location;
  • Dates and times when you go to your doctor, the hospital, and certain other health care facilities;
  • Medicaid, Medicare or other health plan identification numbers or medical record numbers;
  • Profile image;
  • Information about family and friends who are involved in your care;
  • Information about your current or past job history;
  • Inferences about you that we draw from your personal information, such as your preferences;
  • Any other information you share on the Platform or give the Platform permission to access that could be used to identify you. For example, if you call us about the App or use the CSC, we may record the call with the Pyx Health representative. We may also collect and store any electronic communications you send us, such as emails or text messages.

Other information we might collect about you includes but is not limited to:

  • Information you give us about how you are feeling;
  • Your social determinants of health (“SDOH”), such as whether you have enough food to eat and a safe place to sleep;
  • Platform activity and usage (such as whether the Platform is on and how often you use the Platform);
  • The operating system your device uses (for example Android versus IOS);
  • Whether you have clicked on a link to a website accessible through the Platform (such as 211.org); and
  • Other similar Platform activity.

This other information may or may not identify you. Your personal information does not include any deidentified information we collect.

You can choose not to provide information to us, but certain personal information and other information about you is required in order for you to use the Platform.

 

How the Platform accesses other applications and data on your device

With your permission, the Platform may request access to other data or applications on your device, such as your device’s camera, photo library, contacts, location services, defaults (such as Siri and Search, Notifications, Background Platform Refresh, Cellular Data, Storage), phone dialing (for example, to call the Nurse Hotline) or text messaging application (such as, your “Short Message Service” or “SMS”). You can take back your permission by accessing the Pyx Health Platform in your device’s settings.

Text messages and push notifications

If you (or your health care provider or health plan) have chosen to provide the Platform with information about your doctor’s appointments, medications, prescription refills, and other matters related to your care, you may receive push notifications (such as text messages) reminding you of these events or asking you to open your Platform for details about these events. We may also notify you of important information and events that may affect your health or care, such as a natural emergency disaster in your area. You may receive these notifications through your device’s SMS (other text messaging application) and notification features. These communications may not be secure (not encrypted). There are risks associated with unsecure communications that you should consider. These risks include (without limitation) that an unauthorized person may get access to and read these communications. By using the Platform, you are agreeing to accept these risks and consent to receive unsecure communications. 

If you wish to opt-out from receiving push notifications, you may turn them off in your device’s settings. You may also opt-out by replying “STOP” in response to a text message. This opt-out process does not apply to live phone calls or emails, which may continue in case we need to reach you.

How Pyx Health uses and stores your information

We use your personal information and other information we collect on the Platform to provide the services to you and to help connect you with community services and support. We also use this information for general purposes, such as to assist you with using the Platform; to communicate with you through the Platform, your device’s SMS or other means of communication; to customize your experience with the Platform; to manage and improve the quality of the Platform and services that we provide and for other internal business purposes; to perform data analytics and support health care operations; to enforce our Platform Terms of Use; and for any other purpose described to you through the Platform or that you consent to.

We may store your personal information for as long as we need it to provide the services to you and to the extent necessary to comply with our legal and contractual obligations (for example, if we are required to retain your data to comply with laws that apply to us), resolve disputes, and enforce our legal agreements and policies.

With whom Pyx Health shares your information

We may share your personal information and other information with:

  • Anyone authorized by you to have access to your personal information and other information;
  • Your care managers or care coordinators;
  • Your health care providers, your health plan, and people who work with them;
  • People who help us provide the Platform and related services (for example, IT support services), but only as necessary to support our ability to provide the Platform and related services, and subject to security and privacy restrictions; and
  • Our affiliates and business partners for legally permissible purposes.

We may share this information to fulfill the purpose for which you provided it and for purposes of managing your care and normal health care business operations. We will not sell your personal information to advertisers or other third parties without your consent.

We may also share your personal information and other information in response to subpoenas, court orders, requests from law enforcement, or other legal process; to establish or exercise our legal rights; to defend against legal claims; to a buyer or other successor of Pyx Health in the event of a merger, divestiture, restructuring, reorganization, change of control, dissolution, or other sale or transfer of some or all of Pyx Health’s assets, including as part of a bankruptcy, liquidation, or similar proceeding; or as otherwise required or permitted by applicable law.

Deidentified data is not your personal information. Deidentified data is information that does not contain any personal information about you or your family members or friends and for which there is not a reasonable basis to believe that it can be used to identify you. We may use and disclose deidentified data as permitted by the laws and contracts that apply to us.

Website browsers and do not track (DNT) signals

Some website browsers have a “do not track” (DNT) feature that lets you tell other websites that you do not want to have your online activities tracked. No uniform technology standard for recognizing and implementing DNT signals has been finalized. We do not currently respond to a browser’s DNT signal. We are not aware of, and do not knowingly allow, such third parties to track your activity over time on the Platform. However, we may share information about your Platform usage with your health plan or health care providers, or our service providers, contractors, affiliates, and business partners, as described in this Privacy Policy.

Your information and HIPAA

Some of the information we collect about you is protected by HIPAA—the Health Insurance Portability and Accountability Act and its implementing regulations. We may be providing this Platform to you on behalf of your health plan or your health care provider (or a third party that works on behalf of, or provides services to, your health plan or health care provider, such as an accountable care organization). Your health plan or health care provider may share your personal information and other information with others if they are permitted to do so under the laws that apply to them. We cannot control how your health plan or health care provider uses or shares your personal information or other information. Please read your health plan’s and your health care provider’s HIPAA Notice of Privacy Practices for more information about how your protected health information can be used and disclosed under HIPAA. If you have any questions or concerns about how your health plan or health care provider is managing your information, please contact them directly.

Security of your personal information

Pyx Health takes reasonable steps to keep your personal information secure and to protect against the loss, misuse, or alteration of your personal information on the Platform. Although Pyx Health has these security measures on the Platform in place, it cannot guarantee your privacy.  

Please be aware that email and text messaging on your device’s SMS (or other text messaging applications) are not secure (not encrypted) methods of communication. There is the risk that email messages and text messaging on your device’s SMS (or other text messaging applications) could be intercepted or read by other people. If you email us, we will respond to you by email and that email communication will not be secure (not encrypted). Please do not use e-mail to communicate with us about confidential matters. By using the Platform, you are agreeing to accept these risks and consent to receive unsecure communications.

We may also not be permitted by your health plan or health care provider to provide you with all the services or in-App functionality described in this Privacy Policy or Platform Terms of Use. That is because under HIPAA we may be a “business associate” of your health plan or health care provider and thus can only use your personal information as permitted by your health plan or health care provider.

Using the Platform outside of the United States

Pyx Health intends the Platform to be used by residents of the United States. This Platform is not intended for use by individuals who are not located in the United States. If you are visiting our website or using the Platform from outside the United States, please be aware that your personal information and other information will be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. The data protection and other laws of the United States might not be as comprehensive as those in your country. By using our website or Platform, you understand that your personal information and other information may be transferred to our facilities in the United States and those third parties with whom we share it as described in this Privacy Policy.

Third party links

The Platform may contain links to websites that are owned or operated by third parties (for example, 211.org). If you click on a third party link, you will go to that third party website. We do not have control over third party websites and those websites do not operate under this Privacy Policy. You should review the privacy policies of third party websites before using them.

Children’s privacy

Our Platform is not directed at and not intended to be used by any children under the age of 13. You must not use the Platform if you are a child under the age of 13. We do not knowingly collect or solicit any information from children under the age of 13 or knowingly allow such children to use the Platform. A parent or guardian is required to provide consent for Pyx Health to collect, use, or share personal information from a child under the age of 13. Your health plan or health care provider may require you to be at least 18 years of age or older in order to use the Platform.

Children under the age of 18 may request that any information posted to the Platform be removed by contacting us at: [email protected]. Removing information posted to the Platform does not guarantee complete or comprehensive removal of the content or information posted. 

Correction of information; cancellation; misuse of information

Please contact us at [email protected] to:

  • Request that we correct, delete, or change personal information;
  • Cancel your participation; or
  • Report misuse or an unauthorized disclosure of personal information.

It might not be possible for us to correct, delete, or change personal information that has already been shared. Deleting information posted to the Platform does not guarantee complete or comprehensive removal of the content or information posted. 

Please contact us immediately if you believe there is any non-compliance with this Privacy Policy.

Governing law and jurisdiction

Arizona law governs the interpretation of these Terms of Use and Platform Privacy Policy, and will apply if there are disputes. Disputes will be settled in Pima County, Arizona. Pyx Health will decide if disputes will be settled through an arbitration process. Any such arbitration process will be by Pyx Health.

Platform Terms of Use

Your use of the Platform is also subject to Pyx Health’s Platform Terms of Use. Any disputes related to this Privacy Policy will be governed by the applicable provisions of the Platform Terms of Use, which are incorporated into this Privacy Policy by reference.

Privacy Policy changes

We may change this Privacy Policy at any time and for any reason. You can access the most current version of the Privacy Policy that applies to your use of the Platform through the Platform. You can also contact us at [email protected] for a copy.

Unless otherwise specified by us, all changes will be effective upon being updated in the Platform. You should look at this Privacy Policy on a regular basis. The most recent “Effective Date” is posted at the top of this Privacy Policy. You agree to any changes to the Privacy Policy by your continued use of the Platform after the Effective Date. If you do not agree to the changes, you must stop using the Platform.

We may also notify you of major changes by a push notification to the mobile phone number you provided to us. By agreeing to this Privacy Policy, you agree to receive such push notifications.
